RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT

IN CONSIDERATION of being permitted to engage in all Outdoor Recreational Activities, including but not limited to hunting, during Twin Cities to Kansas City BBQ Run, on property located in Bourbon, Miami, and/or Linn County, Kansas ("PROPERTY") owned by George J. McLiney, Jr., Edward D. McLiney, George J. McLiney, III, their respective family members, or a corporation, limited liability company or trust in which either has an interest ("OWNERS"), and at the pleasure of the OWNERS, each of the undersigned person(s) (hereafter "PARTICIPANT"):

1. HEREBY RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE the OWNERS from all liability to the undersigned, personal representatives, assigns, heirs, and next of kin for any and all loss or damage, and any claim or demands therefor on account of injury, of whatever nature, whether caused by the negligence of the OWNERS, EMPLOYEES OR INDEPENDENT CONTRACTORS OF THE OWNER OR OTHER PARTICIPANTS or otherwise while the PARTICIPANT is in or upon the PROPERTY or engaging in any Outdoor Recreational Activities;

2. ACKNOWLEDGES AND AGREES that they know the inherent hazards and risks involved in this activity, including but not limited to:

  1. Risk of injury from the activity and equipment utilized is significant including the potential for permanent disability and death.
  2. Possible equipment failure and/or malfunction of their own or other's equipment.
  3. This activity takes place outdoors and therefore includes risks associated with exposure to elements, excessive heat, hypothermia, impact of the body upon the water and encountering objects either natural or man-made.
  4. My own negligence and/or the negligence of others, including but not limited to operator error and guide decision making including misjudging terrain, weather and/or trails.
  5. Attack by or encounter with insects and/or animals.

3. AGREES TO abide by all federal and state statutes and regulations governing the activities in which PARTICIPANT is engaged and shall abide by all rules, regulations and directions of OWNERS including but not limited to:

  1. Staying within the PROPERTY fence line at all times;
  2. Refraining from bringing drugs or other illegal or intoxicating substances onto the property, and refraining from the use of alcohol while on PROPERTY and engaged in use of a motor vehicle or firearm or other dangerous activity;
  3. Refraining from damage to fences, buildings, or other property; and
  4. Refraining from starting fires without the express consent of the OWNER;

4. Agrees that this permission is granted only to the PARTICIPANT and for the period or time frame stated and that PARTICIPANT will not cause or allow any unauthorized person onto OWNER'S PROPERTY and further, that PARTICIPANT will leave OWNER'S PROPERTY immediately upon request of OWNER or his or its agent.

5. AFFIRMS he or she is the guardian of the MINOR PARTICIPANT(S) listed below:

PARTICIPANT acknowledges and agrees that by execution of this Release and Waiver of Liability and Indemnity Agreement, that all of the foregoing provisions of this Release Agreement shall apply to and on behalf of said MINOR PARTICIPANT(S). In the event of accident, losses, damages or injuries resulting from the MINOR PARTICIPANT(S) participation the PARTICIPANT, the parents/guardians of minor guest(s) and MINOR PARTICIPANT(S) agree to access their own financial resources, including but not limited to their own personal health insurance, private insurance, and federal or state social services programs. PARTICIPANT further agrees to assume all cost related to any such medical treatment and will indemnify, defend and hold harmless OWNER for medical treatment and all other damages claimed by MINOR PARTICIPANT.

THE UNDERSIGNED PARTICIPANT HAS READ AND VOLUNTARILY SIGNS THE RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT
